Copyrighted Works
Permission must be sought when digitizing copyrighted works, unless the use falls under an exemption. Because copyright law now offers automatic copyright protection, always assume the work has copyright protection until proven otherwise. However, there are many exceptions depending on the circumstances, so keep reading!
If the library must obtain permission to use the work, consult a copyright clearance center, such as the Copyright Clearance Center (CCC). After getting permission, libraries still must include a notice of copyright protection. Orphaned works, or works still under copyright whose copyright holder cannot be found, still present a problem for libraries. In this case, look for copyright exceptions like Fair Use or find a similar work.
